Comparsion of euthanasia legislation in selected countries of Europian countries.

Bachelor's thesis deals with topic of legislative regulation of euthanasia in Europe. Especially with regulation of countries, in which is legalized active euthanasia. The aims of this thesis are comparation of these legislations with recommendation of Council of Europe, WMA and to get more complex perspective of laws about euthanasia in Europe. At first, I will define the comprehending of euthanasia in context of legislative and next I will point out an argumentation of supporters and opponents. Following part is containing revelation of legislative in these countries: Netherlands, Belgium, Luxembourg, Switzerland, Germany and Czech Republic. Last two parts speak about post of WMA and Council of Europe, and then are aimed on comparation of those posts.

Euthanasia and related issues

The diploma thesis is focused on the legal institute of euthanasia and related issues with emphasis on the criminal law aspect. The aim of this work is to introduce the reader to the concept of euthanasia, to provide an analysis of basic human rights related to euthanasia, an analysis of the criminal law of euthanasia in the Czech Republic and a comparison of euthanasia legislation in European countries. The work offers the author's reflection on legislative proposals in this area and a controversy over whether the criminal law sufficiently reflects social needs. The thesis is divided into seven chapters, some of which contain subchapters. In the first part, the author clarifies the research issues and goals of the thesis. In the second chapter, the author offers an introduction to the issues of law and punishment, he also introduces the reader to the concept of euthanasia. The most comprehensive third part of the thesis is focused on the controversy regarding the existence of the right to death, the view of the right to death in the context of human rights and freedoms from the point of view of the ECtHR and the comparison of euthanasia legislation in selected European countries. The problematics of the evolution of euthanasia and assisted suicide in the United States of America in relation to the development of global human rights

My thesis addresses the question of how the issue of euthanasia and physician-assisted dying in the United States of America has been evolving in relation to the development of human rights. Taking a long-term view, arguments of the current debate on the issue of evaluation of both practices, euthanasia and physician-assisted dying has revealed the persistent controversial stance on moral justifications of ethics dissonance and the economic response. The point is to illustrate the scope of the dissociation by analyzing arguments and counter- arguments in relation to the question of the bilateral interweaving and interaction with respect for fundamental human rights and a synopsis of the ethics of dying that take into account the abuse of euthanasia and physician-assisted suicide. The interpretation of the development of the attitude of American society and the American medical diaspora has been reflected. In euthanasia and physician-assisted dying debates, analytical synopsis of the development of tolerance in American society in the context of rational choice in view of the economic, ethical, and religious assumptions and the possibility of an alternative option have been critically scrutinized. Assisted suicide in the context of Czech criminal law Abstract The topic of this diploma thesis is the issue of assisted suicide in the context of criminal law in the Czech Republic. Assisted suicide and euthanasia are not currently legal in the Czech Republic. For this reason, the work transcends the ethical level and many other levels, such as the historical, cultural and religious context. The work is divided into several chapters, which describe in detail the individual topics that relate to assisted murder and are related to it. The first chapter defines the terms assisted suicide as such, its legal aspects and historical development in the Czech Republic and in the world of free will, voluntary, unaccompanied, direct and indirect euthanasia, assisted dying, the doctrine of double effect and eubiosia. It also describes the historical development of suicide, from antiquity to modern history and development in the Czech Republic. Subsequently, the topic of assisted suicide is placed within the framework of valid Czech law. Assisted suicide: Application of assisted suicide models in the Czech Republic This diploma thesis deals with the topic of assisted suicide. The aim of the thesis is to analyze the current legal regulation of this issue in the Czech Republic and to outline models of assisted suicide in selected European countries, whose legal systems allow its performance in whole or in part. The author also deals with the possibility of application of these models or their parts in the Czech Republic. The thesis is divided into four chapters. The author devotes the introductory chapter to the historical development of euthanasia and assisted suicide in Europe from antiquity to the present. This chapter describes how perceptions of this issue have changed and evolved over the years and which influences have affected it. In the second chapter, the author presents the current legal situation of assisted suicide in the Czech Republic. Résumé Euthanasia is and always will be a hot topic of very heated debate among both non specialists and experts. The purpose of my thesis is to provide the reader with information about euthanasia and a list of rules dealing with the issue of euthanasia in selected countries. The introduction outlines the problems of euthanasia. The second chapter is devoted to clarifying the content of the notion of euthanasia, which comes from the Greek word for the phrase, "eu" meaning good and "thanatos" meaning death, a "good death", sometimes we can also meet the looser translation of euthanasia as a beautiful death. The content of the notion of euthanasia in the course of history changed. Today we see euthanasia as an act which one person intentionally ends the life of another person's own request with the intent to end her suffering. In the chapter are identified and defined forms of euthanasia, especially active and passive. The third chapter deals with the European Union's attitude to euthanasia. No law of the European Union explicitly addressed the euthanasia. Health policy in principle falls within the competence of national governments. Euthanasia was and still is one of the most controversial topics. It is a complex problem that involves religious, moral, medical and legal aspects. My thesis is focused on euthanasia in relation to the law. The aim of the thesis is to analyse the issue of euthanasia from the perspective of legislation in the Czech Republic. The thesis consists of five chapters. The first chapter contains introduction to the topic of euthanasia. The second chapter is devoted to the definition of term euthanasia. Euthanasia is a word of Greek origin ("eu"- good and "thanatos"- death). Its meaning is good, beautiful or merciful death. Nowadays the term is used in the sense of intentionally termination of life on request to relieve pain and suffering. This chapter also includes the definition of forms of euthanasia. The third chapter is focused on euthanasia in the sense of killing on request. In this meaning, euthanasia has never been explicitly regulated in the Czech Republic. But it does not mean that the issue of legislation of euthanasia is not actual. This chapter is subdivided into the three parts. The first part is about history of legislation of euthanasia. Criminal Law and Euthanasia

Euthanasia represents one of the most controversial topics around the world. As I mentioned in the first chapter there is no worldwide consistency whether to accept the idea of legalization Active Voluntary Euthanasia ("AVE") or not. The goal of this diploma thesis is not to persuade anybody. In approximately 60 pages of the text I am providing readers with some essential information about euthanasia in the Czech Republic. I am also trying to compare the foreign legal regulation of euthanasia and assisted suicide but theoretical ideas as well. The first chapter is mainly trying to capture the reader's focus and setting the theme of my diploma thesis. The second chapter of my thesis is called ,,The Term Euthanasia". This chapter provides readers with several definitions of euthanasia and Physician Assisted Suicide ("PAS") as well as some historic data. The act of euthanasia has its origin in Greek. First word euthanasia is mentioned in old Greek literature. The term euthanasia is composed from two Greek words. Eu which means good or normal and Thanatos which means death.
